HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12185 OF 2017 ORDER:

This writ petition is filed declaring the action of the respondents 2 and 3 in not considering the representation submitted by the petitioner requesting them not to entertain any registrations with regard to the land in Sy.No.787 of Korremula Village, Ghatkesar Mandal, Ranga Reddy District, presently Medchal District, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. It is to be seen that petitioner already filed civil suit in O.S.No.18 of 2016 for recovery of possession on the file of VIII Additional District Judge, Ranga Reddy District and the same is pending and now the present writ petition is filed seeking injunction against the Sub-Registrar not to entertain the registration in respect of the land in Sy.No.787.

This Court cannot go into the title of the parties and grant injunction. More so, petitioner has already availed alternate remedy and filed suit. As such, he cannot avail two parallel remedies in respect of same cause of action. In view of the same, I do not see any reason to entertain the writ petition. Accordingly the writ petition is dismissed. However, it is open for the petitioner to pursue his remedies in the suit already filed by him. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.04.2017 dv
