In the this writ petition, the petitioner assails the order dated 06-09-2017 passed by the 3rd respondent in terminating her services as Aaganwadi worker as being illegal, arbitrary and violative of principles of natural justice and consequently to set aside the same.

Learned counsel for the petitioner submits that before taking the impugned decision dated 6-09-2017, the petitioner was issued with show cause notice dated 02-06-2017 giving only three days time to the petitioner to submit her explanation and when the petitioner sought for extension of time, the same was refused thereby the petitioner became handicapped from submitting comprehension reply to the said show cause notice as she could not know the substance of the allegations leveled against her. Learned counsel states that itself is explicit proof of violation of principles of natural justice by the respondents. Hence, this writ petition.

Heard the learned Asst. Government Pleader for Women and Child Welfare Department.

A reading of the show cause notice dated 2-6-2017 goes to show that the petitioner was not given reasonable time, muchless sufficient time to respond to the charges and to file her explanation, which itself being in utter violation of principles of natural justice, on this short ground alone, the impugned order of
termination is set aside. However, inasmuch as it is stated that the petitioner has now submitted detailed explanation to the show cause notice dated 2-6-2017, the 3rd respondent is directed to consider the same and pass appropriate orders thereon, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

In the result, the writ petition is allowed to the extent indicated above. Miscellaneous petitions, if any pending in this case are disposed of. There shall be no order as to costs.
