Bobbilla Rajender v. The State Of Telangana
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9674 OF 2018 DATED :23.03.2018 Between :
Bobbilla Rajender S/o.Krishnaiah, Aged about 38 yrs, Occu : Business, R/o.5-335/1F, Choutuppal Village, Main Road, Yadadribhuvanagiri District, Telangana District & others. .. Petitioners And The State of Telangana, Rep., by its Principal Secretary, Revenue Department, Telangana Secretariat, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9674 OF 2018 ORDER :
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (TG). 2.
According to petitioners, land in Sy.No.222/3 of Choutuppal village & Mandal, Yadadri Bhuvanagiri District is a private patta land. While so, the respondents 2 and 3, the District Collector and Revenue Divisional Officer are trying to interfere in their possession and enjoyment and are attempting to erect sign board with the caution that subject land belongs to Government. 3.
A reading of the prayer itself would show that so far no decision is taken by the authorities and so far no board is erected. In other words, the writ petition is filed for pre-emptive direction preventing the authorities from taking appropriate decision. No writ petition can be entertained even before a decision is made by the competent authority. This Court can examine the grievance of aggrieved party, within the parameters of judicial review, only if a decision is made.
4.
With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
