THE HON'BLE SRI JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT APPEAL Nos.670 AND 1082 OF 2006 ORAL JUDGMENT: (Per Hon'ble Sri Justice A. Ramalingeswara Rao) These Writ Appeals arise out of orders, dated 03.01.2006 and 08.02.2006, in W.P.Nos.89 of 2006 and 16592 of 2005, respectively.

The respondents/petitioners sought the relief of regularization of their services by challenging the action of the respondents in engaging/appointing them as Drivers on Contract basis. The appellants herein issued an advertisement on 05.10.1999, inviting applications for the post of Drivers, Conductors and Shramiks (Cleaners) in Hyderabad City and Ranga Reddy Regions. It was indicated therein that the selected candidates would be initially engaged on daily wage basis and thereafter they would be absorbed as regular employees. Their grievance is that they were issued orders of appointment on contract basis, contrary to the advertisement. It is also their case that some of the candidates, who were selected along with them, were issued orders engaging them on daily wage basis. Learned Single Judge disposed of the Writ Petitions directing the appellants to engage the respondents/petitioners on daily wage basis, in case others, who were selected in pursuance of the advertisement, dated 05.10.1999, were engaged on daily wage basis. The said order is challenged by the appellants.

Learned Standing Counsel for the appellants submits that the same benefit that was given to the persons, who were engaged on daily wage basis pursuant to advertisement, dated 05.10.1999, would be given to the respondents/petitioners in the writ petitions also on par with those persons.

In view of the submission made by the learned Standing Counsel for the appellants, we are of the view that there is no necessity to adjudicate the Writ Appeals except recording his statement.

The Writ Appeals are accordingly disposed of as infructuous. No costs.

The Miscellaneous Petitions filed in these Writ Appeals shall stand disposed of.
