Heard Sri V. Eswaraiah Chowdary, learned counsel appearing for the petitioner and Sri A.K.Jayaprakash Rao, learned standing counsel for the respondent-Devasthanam.
2. The petitioner is a sanitary maistry in the respondentDevasthanam. Now he is aged about 58 years and nearing his retirement. While so, on 12.05.2015, on the basis of the report, a criminal case in Cr.No.24 of 2015 was registered against the petitioner. Pursuant to the said criminal case, the petitioner was arrested and was in judicial custody for three days. On that ground, he was suspended and disciplinary enquiry is proposed to be conducted against him.
3. Learned counsel appearing for the petitioner submits that since the criminal case is registered basing on a false report, suspension order passed against the petitioner, needs to be revoked. On the other hand, learned standing counsel for the respondentDevasthanam, submits that since the order of suspension is pending enquiry, it needs no interference in the present writ petition.
4. Considering the submissions made by the learned counsel on either side, the writ petition is disposed of, directing the respondentDevasthanam to complete the enquiry against the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order, and pass final orders in accordance with Rules, failing which the order of suspension shall stand revoked.
