Heard the learned counsel for the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ of mandamus or any other appropriate writ, order or direction declaring the action of the respondent Nos.2 to 4 in not taking any action on the complaint given by the petitioner dated 04.10.2015 against the unofficial respondents as illegal, arbitrary, unjust and also against the principles of natural justice, discriminatory and consequently direct the respondent Nos.2 to 4 to act upon the complaint of the petitioner dated 034.10.2015 in accordance with law by following the procedure contemplated under law."
During the course of hearing, learned Government Pleader brought to the notice of this Court that pursuant to the complaint lodged by the petitioner, a crime vide FIR.No.142 of 2015 was registered and after investigation, the same was referred as "civil in nature" on 06.07.2016. Accordingly, on the instructions of the Assistant Commissioner of Police, Visakhapatnam, East Zone, a final report was filed before the learned IV Judicial First Class Magistrate, Visakhapatnam on 27.07.2016.
In that view of the matter, this Court is of the opinion that no further orders are required in the writ petition. Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 06.12.2018.
