HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.808 of 2015 ORDER:

This petition is filed to withdraw O.P.No.1603 of 2015 from the file of Family Court at L.B. Nagar, Ranga Reddy District and transfer the same to Senior Civil Judge, Peddapalli, Karimnagar District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 15.08.2014 at Peddapalli in Karimnagar District and they both lived happily for sometime and thereafter respondent started insulting her demanding additional dowry and finally she was driven out from marital house, since then she has been residing with her parents and that she delivered a child in the month of June 2015. She further contended that she lodged a complaint before Peddapalli Police Station, which is registered as Crime No.67 of 2015 for the offence punishable under Section 498-A IPC subsequently on filing of charge sheet it was registered as C.C.No.372 of 2015 pending before Judicial First Class Magistrate, Peddapalli. She stated that respondent initially filed OP No.

29 of 2015 before Senior Civil Judge, Peddapalli but withdrew the same on 12.08.2015 and intentionally filed O.P.No.1603 of 2015 before Family Court, L.B Nagar to harass petitioner. She stated that she has no male person to escort her and she has a life threat to herself and to her child at L.B.Nagar and that O.P.No.1603 of 2015 has to be withdrawn from Family Court, Ranga Reddy and transferred to Senior Civil Judge, Peddapalli.

3. Respondent in spite of granting time for filing counter did

not choose to file any counter though 4 adjournments are granted only on the request of respondent.

5. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.1603 of 2015 is withdrawn from the file of Family Court at L.B. Nagar, Ranga Reddy District and transferred to Senior Civil Judge, Peddapalli for disposal in accordance with law.

6. Accordingly, this Transfer Civil Miscellaneous petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 28-03-2016 gvl
