THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9738 of 2018 ORDER:
Heard learned counsel for the petitioners and the learned Government Pleader for Agriculture.
The preliminary notification, issued by the State Government, in exercise of the powers conferred under Clauses (a) & (b) of sub-Section (4) r/w sub-Sections (1) and (2) of Section 3 of the A.P. (Agricultural Produce and Livestocks) Markets Act, 1966, vide G.O.Rt.No.130, dated 08.03.2018, is under challenge in the present Writ Petition. By way of the said preliminary notification, the State Government called for objections on the aspect of exclusion of certain villages and mandals from Nandigama and Jaggaiahpeta Agricultural Market Committee. Petitioners herein have raised objection as to the very notification issued by the respondents, calling for objections.
Learned counsel for the petitioners submits that the preliminary notification issued by the State Government is impermissible and, in the absence of any rules and guidelines, the first respondent-State Government ought not to have issued the primary notification.
On the other hand, it is submitted by the learned Government Pleader that the said contention cannot be
sustained in the eye of law as the State Government called for objections only and, if any such objections are submitted by the petitioners herein, raising all these grounds, the same will be verified and appropriate action would be taken in accordance with law.
Recording the above submission, the Writ Petition is disposed of, keeping it open for the petitioners to submit their objections within a period of fifteen days from today. If any such objections are submitted, the same be considered and appropriate orders be passed strictly in accordance with law. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed. __________________ A.V.SESHA SAI,J 06th April, 2018 Tsy
