HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO. 3123 of 2019 ORDER :

The petitioner, who is accused No.1, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.81 of 2019 of Valigonda Police Station, Rachakonda, registered for an offence punishable under Section 306 IPC. 2.

According to the prosecution case, the informant gave a complaint on 15.05.2019 stating that his son entered into partnership deed with the petitioner, purchased one Ashok Leyland Borewell Vehicle bearing No.TS 05 EP 1377. The said vehicle was registered in the name of his son-in-law (petitioner herein). Subsequently, on 07.07.2018, the balance debts were paid by the son of the informant in terms of agreement and entire amounts were paid by 16.04.2019. As per their agreement, the petitioner has to hand over the bore vehicle with NOC to the son of the informant. But the petitioner failed to do so and he along with one Shyamala Murali Manohar Reddy took the agreement papers forcibly from the son of the informant and threatened him stating that he has no right over the vehicle.

It is alleged that the petitioner also threatened the family of the informant that he would send them to jail by lodging false case. It is further stated that the petitioner threatened the son of the informant that he would see that he would not get married. Keeping all these in mind, the son of the informant committed suicide on 15.05.2019, by hanging on to the roof wood with cord at the time when none of the family members were in the house.

son of the informant died due to psychological pressure made by his son-inlaw. Basing on the said allegations, the present crime came to be registered. 3.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

It has been submitted by the learned counsel for the petitioner that the petitioner is innocent of the offence alleged and he has been falsely implicated in the present crime.

Learned Additional Public Prosecutor opposed the anticipatory bail application. He stated that investigation is still pending and if the petitioner is released on anticipatory bail, there is every chance of evading the process of law.

Looking into the nature of allegations leveled against the petitioner, gravity of the offence alleged and as the investigation is still going on, I am not inclined to grant anticipatory bail to the petitioner. 7.
