THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9746 of 2018 ORDER:

Heard learned counsel for the petitioner, the learned Government Pleader for Energy appearing for the first respondent, learned Government Pleader for Revenue appearing for the second respondent and Sri Zakir Ali Danish, learned Standing Counsel for the second respondent.

When the matter is taken up it is submitted by the learned counsel for the petitioner that, for redressal of his grievance, petitioner herein submitted a representation, dated 13.03.2018, to the District Collector, Jangaon-third respondent herein but no action has been taken so far. It is further submitted that, in the meanwhile, the second respondent authorities are actively proceeding with the construction of an electricity sub-station. It is further submitted that the subject land is a private land belonging to the petitioner herein. On the other hand, it is submitted by Sri Zakir Ali Danish, learned Standing Counsel, on instructions, that the District Collector, Jangaon-third respondent herein has allotted Government land to an extent of Ac.0.20 guntas situated at Jangaon Town and Mandal in Sy.No.390/2 for construction of 33/11 KV sub-station under Integrated Power Development

Scheme and, under cover of panchanama, the Revenue Divisional Officer handed over the said site on 10.03.2018. It is further submitted that if the request of the petitioner is acceded to, at this stage, the same will hamper the further process of construction of the electricity sub-station.

Having heard the learned counsel on either side and taking into consideration the nature of controversy, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the District Collector, Jangaon-third respondent herein to verify the representation, dated 13.03.2018, said to have been submitted by the petitioner, and take appropriate action, strictly in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. Till the District Collector, Jangaon-third respondent herein passes an order, the proposed construction shall be deferred. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
