B. Kistaiah, Karimnagar District. v. Apsrtc, Rep. By Managing Director, Hyderabad.
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18343 OF 2002 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India to declare the action of the respondents in not regularizing the services of the petitioners in spite of putting more than 10 years of service, as arbitrary and illegal and consequently, direct the respondents to regularize the services of the petitioners from the date of completion of 240 days of service from the date of joining along with all other consequential benefits. 2.
Heard learned counsel appearing for the petitioners and learned Standing Counsel appearing for the respondentCorporation.
3.
Learned counsel appearing for the petitioners submits that since the petitioners have been continuously working from the date of their appointment without any interruption, they are seeking regularization of their services.
4.
Learned Standing Counsel appearing for the respondentCorporation contends that proposals have been submitted by the respondent-Corporation to the Government to regularize the services of the similarly situated persons in terms of G.O.Ms.212, dated 22.4.1994.
5.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is issued to the petitioners to
submit a representation to the respondent-Corporation seeking regularization of their services.
6.
Accordingly, the Writ Petition is disposed of directing the petitioners to submit a representation to the respondentCorporation seeking regularization of their services within a period of one week from the date of receipt of a copy of the order and on receipt of such representation, the respondent-Corporation shall consider the same and pass appropriate orders within a period of four weeks thereafter.
Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
