This transfer petition is filed to transfer FCOP No.641 of 2015 pending on the file of the Family Court Judge, City Civil Court, Hyderabad to the Court of Family Court Judge, District Courts, Guntur.

It is the case of the petitioner that the marriage of the petitioner with the respondent was performed on 24.02.2007 as per Hindu Rites and Customs at Anna Srinivasarao Kalyana Mandapam, Kothapet, Guntur in the presence of elders. Petitioner is an employee of Ministry of Defence in the Central Government. When the respondent harassed the petitioner, she filed complaint with the Police and same is registered as FIR No.70 of 2015 by the Guntur Urban Police Station. That it is very difficult for her to travel all the way to Hyderabad from Guntur. As such, she sought for transfer of FCOP No.641 of 2015 pending on the file of the Family Court Judge, City Civil Court at Secunderabad to the Court of Family Court Judge, District Courts, Guntur. Though notice is issued to the respondent, the same was unclaimed by the respondent. Hence, the same is treated as deemed service on the respondent.

Heard learned counsel for the petitioner.

It is to be seen that the facts and circumstances referred to supra are un-rebutted by the respondent. Since the petitioner is working at Secunderabad and the FCOP filed by the respondent is pending before the Family Court Judge at Secunderabad, I do not see any difficulty in attending the Court by the petitioner. In the entire affidavit filed in support of this petition, the petitioner has not stated what the difficulty is in attending the Family Court at Secunderabad, except stating that she is native of Guntur. Moreover, it is convenient for the petitioner to attend the Court at Secunderabad. No reasons assigned for transferring the FCOP No.641 of 2015 to the Court of Family Judge, at Guntur. Hence, I do not see any ground to entertain this Transfer

Petition.

Accordingly, this Transfer Petition is dismissed with costs of Rs.1000/- to be payable to the credit of Telangana State High Court Legal Services Authority, Hyderabad. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
