HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.4482 OF 2012 ORDER:

This writ petition is filed by the petitioners seeking to declare the action of the respondents in trying to encroach upon their property admeasuring 1225 sq. yards situated at Chintabavi, Chilakalaguda, Secunderabad, without following due process of law. 2.

It is the case of the petitioners that the father of the 1st petitioner purchased the property in question. Subsequently, a suit is filed for partition of the said property among the family members. While so, the respondents are trying to grab the said property under the cloak of acquisition, without issuing any notice. Hence, the present writ petition is filed.

Heard and perused the material available on record. 4.

The main grievance of the petitioners is that the respondents without issuing any notice and without following any due process of law, are trying to interfere with the property in question. 5.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed not to interfere with the possession and enjoyment of the petitioners over the property in question, without following due process of law." 6.
