THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13552 of 2012 ORDER:

The grievance of the petitioners was that the police authorities were not providing protection to them and their property from the accused in Crime No.57 of 2012 on the file of Bibinagar Police Station, Nalgonda District.

Relying on the written instructions dated 07.09.2015 received from the Sub-Inspector of Police, Bibinagar Police Station, Nalgonda District, the learned Assistant Government Pleader for Home informed this Court that upon the private complaint filed by one Kolichalima Balraju before the learned Judicial Magistrate of First Class, Bhongir, being forwarded to it, the Bibinagar Police Station registered Crime No.57 of 2012 under Sections 427, 447 and 506 I.P.C. read with Section 34 I.P.C. against three persons.

After completion of investigation, the Investigating Officer arrested the accused and they were thereafter remanded to judicial custody. A charge sheet was also laid against the accused before the learned Judicial Magistrate of First Class, Bhongir, which was taken on file in C.C.No.460 of 2012. The case was stated to be pending trial.

In the light of the afore-stated developments, the cause for the petitioners to complain that they need protection from the accused in Crime No.57 of 2012 on the file of Bibinagar Police Station does not survive. In the event there is any commission of an offence by the accused in the said crime, it shall be open to the petitioners to approach the police authorities for taking necessary action in accordance with law.

Subject to the above observation, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
