The only grievance of the petitioner is that he filed appeal before the 2nd respondent on 23.08.2018 along with stay petition against the order passed by the 3rd respondent dt.24.08.2011 in LTR Case No.217/2010/DPT and the same is not being disposed of. Because of the same, the respondents are trying to evict the petitioner. Heard learned counsel for the petitioner.
Since the statutory appeal filed by the petitioner is pending before the 2nd respondent, without expressing any opinion on merits, the 2nd respondent is directed to dispose of the appeal filed by the petitioner in accordance with law within a period of four weeks from the date of receipt of a copy of this order. Till determination of appeal, status-quo as on today regarding possession over the subject lands shall be maintained. It is open for the unofficial respondents to raise all their objections before the appellate authority and the appellate authority is to consider the same.
With the above direction, this writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
