THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10294 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents in not affecting the stagnation increments w.e.f. March, 2005 on completion of 12 years of service as Conductor in pursuance of the Circular No. PD.65/89 dated 03.05.89 is illegal, arbitrary and unjust and consequently direct the respondents to grant stagnation increments w.e.f. complete of 12 years of service i.e., March, 2005 i.e,. the date of releasing of increments to the petitioner in pursuance of Circular No. PD.65/89 dated 03.05.89 and to pay all consequential benefits." Heard Sri G. Ravi Mohan, learned counsel for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for respondents.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 0406-2015 to the 1st respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 1st respondent to pass appropriate orders on the representation, dated 04-06-2015, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and submitted that the said representation would be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 1st respondent to consider and pass appropriate orders on the representation, dated 04-06-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two

(2) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
