ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in Crime No.149 of 2026 of Saroornagar Police Station, Malkajgiri Commissionerate, registered for the offences punishable under Sections 69 of the Bharatiya Nyaya Sanhita (for short 'BNS').

The brief facts of the case are that, on 14.02.2026, the de-facto complainant lodged a report before the police stating that the accused was her schoolmate, who developed a relationship with her by promising marriage and repeatedly had physical relations with her on that pretext. Later the accused avoided marriage, revealed that he had already married another woman, and cut off contact. When questioned, the accused and his family allegedly abused and threatened the victim. Hence, the complainant requested to take necessary action. Based on the said complaint, the police registered a case against the petitioner for the aforementioned offences. 3.

Heard Sri K. Srujan Manohar, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the relationship between the petitioner and the de-facto complainant was consensual in nature. It is further submitted that there is no inducement and there is no deceitful intention committed by the petitioner. Even

according to the complainant, the petitioner herein took the de-facto complainant to his parents for the purpose of marriage and his parents did not accept for their marriage, which itself shows that there is no deceitful intention by the petitioner. The petitioner is in jail from 18.03.2026 and the material part of the investigation is already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that the alleged offences are grievous and heinous in nature and the material part of the investigation is not yet completed. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 18.03.2026, who is arrayed as accused and the relationship between the parties is from the year 2023, and even according to the de-facto complainant, the

petitioner took her to his parents house, wherein the petitioner's parents did not accept to their marriage proposal. Material part of the investigation is already completed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration and also considering the remand report and the petitioner is in jail from 18.03.2026, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions. i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned V Additional Metropolitan Magistrate, Ranga Reddy District at L.B. Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation,

and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
