THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Contempt Case No.944 of 2017 ORDER: (per Hon'ble the Acting Chief Justice Sri Ramesh Ranganathan) The order, violation of which is alleged in this Contempt Case, was passed in W.P.(PIL) No.1 of 2017 dated 03.01.2017. In the said order we observed that the State Government, having constituted a committee to examine the matters referred to in the Writ Petition, should have considered calling upon the committee to submit its report at an early date to enable them to take a considered decision in this regard. We, however, made it clear that, in the exercise of the power of judicial review under Article 226 of the Constitution of India, we would not issue any specific directions in this regard to the State Government.

The present Contempt Case is filed, alleging violation of this order, on the sole ground that the State Government has not examined the report of the committee. We had made it clear, in the order passed in W.P.(PIL) No.1 of 2017 dated 03.01.2017, that we were not issuing any specific direction to the State Government in this regard. It is only if a direction had been issued, would it have been open to the petitioner to contend that the order of this Court had been violated, necessitating exercise of jurisdiction under the Contempt of Courts Act. As no specific direction was issued to the State Government, the petitioner cannot be heard to contend that

the respondent has violated the order of this Court, much less wilfully and deliberately. We see no reason, therefore, to proceed against the respondent under the Contempt of Courts Act, 1971.

The Contempt Case fails and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. ________________________________ RAMESH RANGANATHAN, ACJ ____________________________ A.SHANKAR NARAYANA, J Date:30.06.2017.
