United India Insurance Company Limited v. Kurdula Sattevva And ANR
THE HONOURABLE SMT JUSTICE LALITHA KANNEGANTI M.A.C.M.A.No.4079 of 2008 JUDGMENT:
This appeal is preferred by the appellant-Insurance Company aggrieved by the award whereby interest was granted at 9% per annum while granting compensation of Rs.81,600/- to the 1st respondentclaimant in O.P.No.88 of 2002 on the file of the Motor Accident Claims Tribunal-cum-VI Additional District Judge, Nizamabad at Kamareddy, dated 19-09-2006. The 1st respondent/claimant has filed the said OP claiming compensation of Rs.2,00,000/- for the injuries sustained by her in the accident.
2.
This Court has appointed Smt V. Satya Manjula, as counsel for the appellant-insurance company. She submits that in the year 2002, as per the procedure envisaged, interest was granted at 6% per annum only and as such, interest granted by the Tribunal may be reduced from 9% per annum to 6% per annum.
3.
In all the cases, this Court is now passing orders granting interest at 7.5% per annum on the enhanced amount, but not disturbing the earlier interest that is granted at 9% per annum. In view of the same, this Court finds no merit in the present appeal. 4.
Accordingly, the Appeal is dismissed. No order as to costs.
LK, J MA CMA.No.4079 of 2008 5.
Miscellaneous petitions, if any pending in this appeal shall stand dismissed.
