HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32503 of 2016 ORDER:

The case of the petitioner is that the Bharat Petroleum Corporation gave letter of intent dated 04.04.2012 to the petitioner for establishment of MS/HSD Retail Outlet dealership and in pursuance of the same the Bharat Petroleum corporation addressed a letter dated 25.08.2015 to the 2nd respondent to issue NOC. Since the respondent authorities did not grant NOC, the petitioner is unable to establish retail outlet. Aggrieved by the same, present writ petition is filed.

Learned Assistant Government Pleader for revenue as well as learned Standing Counsel for the 3rd respondent submits that the subject land which was allotted to the petitioner is not meant for establishment of petrol bunk and that the same is allotted for small entrepreneurs.

It is stated by the learned counsel for the petitioner that the 4th respondent has also addressed letter dated 20.01.2016 to the Manager of the 3rd respondent to send early reply in this matter. In view of the above facts and circumstances, it is for the 2nd respondent to consider the application of the petitioner. As such, without expressing any opinion on merits, the 2nd respondent is directed to dispose of the application dated 25.08.2015 in accordance with law after considering objection if any and take

action within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
