THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CRIMINAL PETITION No. 3423 OF 2019 O R D E R:

This Petition was filed seeking a direction to the respondent Police to follow the procedure prescribed under Section 41-A of the Code of Criminal Procedure and the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1. Heard learned counsel for the petitioner as well as the learned Public Prosecutor.

A case in Crime No. 120 of 2019 on the file of Rachakonda Police Station was booked against the petitioner for the offences punishable under Sections 420, 406, 467, 416, 417 and 120-B read with Section 34 of the Indian Penal Code. Since the simple and innocuous prayer is a direction to the respondent police to follow the guidelines issued in Arnesh Kumar's case (supra), the Criminal Petition is disposed of directing the respondent police to strictly adhere to the guidelines framed by the Apex Court in Arnesh Kumar's case (supra), before taking further steps.
