HON'BLE SRI JUSTICE G. CHANDRAIAH & HON'BLE SRI JUSTICE U.DURGA PRASAD RAO W.P.No. 2224 of 2016 DATE: 01.02.2016 Between:

Bharat Sanchar Nigam Limited (BSNL) and three others .. Petitioners And B. Kanka Ramulu and two others .. Respondents

O R D E R:- (per Hon'ble Sri Justice U. Durga Prasad Rao) Heard the learned Standing Counsel for Bharat Sanchar Nigam Limited appearing for the petitioners and perused the impugned order dated 08.12.2014 in O.A.No. 020/00592/2014 passed by the Central Administrative Tribunal, Hyderabad Bench, Hyderabad.

The following order is passed by the Tribunal in the initial stage:

"In the result, the impugned orders dated 31.03.2014 and 21.05.2014 are quashed and set aside and the applicant is entitled to all the consequential benefits.

The O.A. is allowed accordingly. No order as to costs." A perusal of the order would show that the learned Tribunal has passed its order considering the effect of Rule-21 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 (for brevity "CCS Rules). As the impugned order is passed after considering the effect of Rule 21 of the CCS Rules, the same does not suffer from any irregularity or illegality.

Hence, we find no merit in this writ petition and the same is accordingly dismissed. No order as to costs. As a sequel to the dismissal of the writ petition, Miscellaneous Petitions, if any pending, shall stand

disposed of as infructuous.
