This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying this Court to enlarge the petitioner on bail who is arrayed as accused No.4 in Crime No.24 of 2026 of Vemulawada Police Station, Rajanna Sircilla District. The offences alleged against the petitioner are under Sections 103(1) r/w.3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The case of the prosecution is that on 13.01.2026 at about 09:30 hours, the complainant lodged a complaint stating that two years prior thereto, his son married Kolasani Shireesha, and they were blessed with a daughter. It is stated

- 2 - that on 12.01.2026 at about 09:00 p.m., his son left the house stating that Ummareddy Raju had telephoned him and that he would return shortly. As his son did not return even by midnight, the complainant contacted him over phone at about 12:00 midnight, and his son informed him that he would return home within twenty minutes. However, he did not return thereafter and on 13.01.2026 at about 05:48 a.m., Narendla Gowtham Reddy informed the complainant over phone that his son was lying in an injured condition at the Government Area Hospital, Vemulawada. On receiving the said information, the complainant along with his family members rushed to the hospital and found his son with severe injuries. The complainant further stated that he strongly suspects that Ummareddy Raju, Ummareddy Vishnureddy, along with some others, jointly assaulted his son and caused his death. Hence, requested the police to take necessary action against the accused.

Heard Sri K.Ravikanth, learned counsel appearing on behalf of the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

The contention of learned counsel for the petitioner is that in the complaint initially there is no suspicion raised against the petitioner and the petitioner herein is no way connected with the said offence. He is falsely implicated in this case. Learned counsel further contended that A.1 to A.3 are already granted bail by the trial Court and petitioner herein is in jail from 22.01.2026 and even after completion of 90 days, charge sheet is not filed and on that ground also, petitioner is entitled to bail and prayed this Court to grant regular bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the alleged offences against the petitioner are serious and heinous in nature and investigation is not yet completed. Hence, petitioner is not entitled to bail and prayed to dismiss this petition.

Considering the submissions made by both counsel and the material on record, the petitioner is in jail from 22.01.2026. As seen from the order passed by the trial Court, no charge sheet is filed as on the date of order and even till today. However as A.1 to A.3 are already granted bail by the trial Court, considering the same, this Court is inclined to grant regular bail to the petitioner subject to the following conditions :

- 4 - i. The petitioner shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class at Vemulawada.

ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
