THE HONOURABLE SRI JUSTICE RAJA ELANGO Crl.P.M.P.Nos.10818 and 10819 of 2016 in Crl.P.No.5356 of 2013 & CRIMINAL PETITION No.5356 of 2013 ORDER:
This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner/A.5 seeking to quash the proceedings in Crime No.113 of 2013 of Vemulawada Police Station, Karimnagar District, registered for the offences punishable under Sections 420, 423 and 417 I.P.C.
2. Crl.P.M.P.No.10818 of 2016 is filed by the de facto complainant to quash the proceedings in Crime No.113 of 2013 against the respondent No.2/A.5 in terms of Joint Compromise Memo
3. Crl.P.M.P.No.10819 of 2016 is filed by the de facto complaint to permit him to compound the offences.
4. When the matter is taken up for hearing, the de facto complainant stated that he entered into compromise with the petitioner/A.5 herein and also filed Joint Memo of Compromise along with the petition and therefore, prayed to grant permission to quash the proceedings in Crime No.113 of 2013 against petitioner/A.5 by compounding the offences.
5. Both the parties are present and they are identified by their respective counsel. The parties, who are present in the Court, stated that the matter has been settled outside the Court and filed Joint Memo of Compromise to that effect. A perusal of affidavit filed in support of the petition goes to show that the matter has been settled amicably between the parties.
6. In view of the amicable settlement of the dispute between the parties, Crl.P.M.P.Nos.10818 and 10819 of 2016 are ordered and the compromise is recorded. Consequent thereto, the Criminal Petition is allowed quashing the proceedings in Crime 113 of 2013 of Vemulawada Police Station,
Karimnagar District, against the petitioner/A.5 is concerned. It is directed that this compromise shall form part of the record. Miscellaneous petitions, if any, filed in this appeal shall stand closed. __________________ RAJA ELANGO, J 27.08.2016 YVL THE HONOURABLE SRI JUSTICE RAJA ELANGO
