HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9239 OF 2017 ORDER:

Heard learned counsel for the petitioners/ A1 to A3 of Crime No.145 of 2017 dated 03.09.2017 of Mandapeta Town Police Station, East Godavari District, registered for the offences punishable under Sections 323, 506 r/ w 34 I.P.C. and 3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1 of 2016 (for short 'the Act') and learned Public Prosecutor appearing for the State, before ordering notice to respondent Nos.1 to 4 and perused the grounds in the Criminal Petition and the contents of F.I.R.

As pointed by the learned counsel for the petitioners that there is no accusation worth to attract any of the penal sections under 3(1)(r)(s) of the Act but for if at all Sections 323, 506 I.P.C. and Section 3(2)(va) of the Act.

Having regard to the above, there is nothing to interdict the investigation. However, the petitioners/ A1 to A3 shall not be arrested pending investigation. This will not prevent the Police from securing the petitioners for the purpose of investigation as and when required.

Accordingly, the Criminal Petition is disposed of. Pending miscellaneous petitions pending if any shall stand closed.
