HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4020 of 2014 ORDER :

This criminal petition is filed by the petitioner/accused under Section 482 Cr.P.C to quash the proceedings in Crime No.33 of 2014 of Ongole I Town Police Station, Prakasam District registered for the offences punishable under Sections 323, 354 read with 34 I.P.C.

2) It is represented by the learned Public Prosecutor that the prosecution agency filed charge sheet after investigation in the above crime and the present proceedings sought for against the F.I.R no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous. The petitioners can file an application under Section 239 Cr.P.C before the learned Magistrate, if there are any grounds for discharge and further remedy in the event of framing charges is left open to the petitioners.

4) Miscellaneous petitions, if any pending, shall stand closed.
