Order:

This Writ Petition is filed for a Mandamus to declare the action of the respondents, in seeking to prosecute the petitioner in pursuance of the enquiry report under Section 51 of the Andhra Pradesh Cooperative Societies Act, 1964, as illegal and arbitrary.

At the hearing, Mrs.Bobba Vijaya Lakshmi,

learned Counsel for the petitioner, submitted that as the respondents have stated in their counter-affidavit that prosecution had already been launched against the petitioner and another person vide Order, dated 12.10.2011, her client may be permitted to withdraw the Writ Petition with liberty to avail a fresh remedy by questioning the said proceeding.

The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, interim order, dated 28-10-2011, is vacated and WVMP.No.51 of 2012 and WPMP.No.35664 of 2011 are disposed of as infructuous.
