THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.8635 of 2017 ORDER:
In this petition filed under Section 482 Cr.P.C, petitioners/A2 & A3 seek to quash proceedings against them in SC No. 341 of 2017 on the file of XV Additional District & Sessions Judge, Kukatpally at Miyapur, Ranga Reddy District. A1 is the husband of the deceased. Petitioenrs/A2 & A3 are the parents in law of the deceased who died under suspicious circumstances by hanging to a fan rod in the matrimonial home. The police after investigation laid charge sheet against them under Section 304-B IPC.
Heard.
A perusal of the statements of the witnesses and the charge sheet would reveal a strong prima facie case against the petitioerns/A2 & A3 at this stage. Of course, their culpability or cognizance has to be decided during the trial. As such, it is not a fit case to quash the proceedings. However, considering the submission of the learned counsel for petitioners that the petitioners/A2 & A3 are old persons and petitioner/A3 is suffering with defective eye vision, their presence before the trial Court is dispensed with except on the occasions when the trial Court considers and directs them to attend.
Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed. _________________________ U.DURGA PRASAD RAO, J Date: 19.09.2017 KA
