HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRL.M.P.NO.6017 OF 2015 IN/AND CRIMINAL PETITION No.6083 OF 2015 COMMON ORDER:
The Criminal Petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in S.C.No.320 of 2014 on the file of Metropolitan Sessions Judge, Hyderabad, where the cognizance was taken for the offence punishable under Section 307 I.P.C at the post committal stage, outcome of the report of de facto complainant in Crime No.95 of 2013 of Shahinath Gunj Police Station.
Heard the learned counsel for the petitioner and the learned counsel for respondents.
Pending the Criminal Petition, Crl.MP(S.R.).No.19974 of 2015 is filed seeking permission of the Court to compound the offence in the above said S.C.
The de facto complainant and the accused, who are own brothers are present before the Court and they identified by their respective counsel and stated that they settled the matter amicably outside the Court at the intervention of elders, to purchase piece and in the welfare of both families. Though the offence under Section 307 I.P.C. is not compoundable under Section 320 Cr.P.C. by invoking Section 482 Cr.P.C. the same is compounded. Accordingly, Crl.M.P.(S.R.) No.19974 of 2015 is ordered and the Criminal Petition is allowed by quashing the proceedings in S.C.No.320 of 2014 on the file of Metropolitan Sessions Judge, Hyderabad.
