HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38456 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the inaction of the respondents in taking steps for seizing the borewell dug by the unofficial respondents in survey No.9-4E to an extent of Acs.499 cents of Basampally Village, Kanumukkala Revenue Village, C.K.Palli Mandal, Ananthapur District without any permission, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents 1 to 3. With their consent, the writ petition is disposed of at the admission stage itself. There is no necessity to put respondents 4 to 6 on notice since this Court is not venturing to adjudicate the case on merits.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction for disposal of the representation made by the petitioner on 16.06.2015, at the earliest.

Learned AGP would submit that the representation of the petitioner was forwarded to the Tahasildar by the Revenue Divisional Officer and as such, a suitable direction may be given to the 3rd respondent-Tahasildar to dispose of the representation of the petitioner, if the same is still pending consideration, in accordance with law.

Having regard to the rival submissions made and taking into consideration the history of the case, the Writ Petition is disposed of directing the 3rd respondent to deal with the representation made by the petitioner on 16.06.2015 questioning the inaction of the official respondents as against the unofficial respondents, in accordance with law, and pass necessary orders thereon after hearing the petitioner and other aggrieved persons, if any including the unofficial respondents herein, as early as possible, preferably within a period of 4-6 weeks from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
