THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL REVISION CASE No.1814 of 2017 ORDER:

This revision is preferred under Sections 397 and 401 of Code of Criminal Procedure (fort short "Cr.P.C.") questioning the legality of the order dated 09.05.2017 passed in Crl.M.P.No.470 of 2017 in C.C.No.75 of 2015 by the VIII Special Magistrate, L.B.Nagar at Hasthinapur, who allowed the application filed under Section 311 of Cr.P.C. to recall L.Ws.1 to 5 to record their evidence.

Trial Court allowed the application filed under Section 311 of Cr.P.C. and issued summons L.Ws.1 to 3. Against the order passed in a petition filed under Section 311 Cr.P.C., no revision is maintainable in view of the judgment of the Apex Court in "SETHURAMAN v.

RAJAMANICKAM1"

In view of the law declared by the Apex Court in "SETHURAMAN v. RAJAMANICKAM" (referred supra) this revision is dismissed at the stage of admission. The miscellaneous petitions pending, if any, shall also stand closed.
