HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.12994 OF 2012 ORDER:

The writ petitioners seek a writ in the nature of Mandamus declaring the action of the respondents in failing to consider the application of the petitioners dated 20.04.2002 for grant of police protection to the respondents 3 and 4 while performing the duties in conducting survey and assessing the mining area in Survey Nos.58/1/8/A/1, 58/1/9/A/1, 58/1/45, 58/1/24/B/1, 58/1/14/A/1 and 58/1/47/A/1 to an extent of Acres 82.00 situated at Hanamkonda, Warangal District as illegal and arbitrary and consequently, to direct the respondents 1 and 2 to take necessary action on the application of the petitioners dated 20.04.2012.

Heard learned counsel for petitioners and learned Government Pleader for Home for respondents 1 and 2, learned Government Pleader for Revenue for respondent No.3 and learned Government Pleader for Mines and Geology for respondent No.4.

When the matter came up for hearing, learned Government Pleader for Home, on written instructions, would submit that pursuant to the application of the petitioners dated 20.04.2012, the Sub Inspector of Police, Nallabelly

Police Station, has provided police protection to Tahsildar, Nallabelly Mandal, on 22.04.2012 to facilitate the survey of the petitioners lands. Further on 07.05.2012, the Revenue Divisional Officer, Narsampet, has addressed a letter to the Sub Divisional Police Officer (SDPO), Narsampet, vide Rc.No.E/287/2012, requesting to provide police protection to the petitioners in respect of lands in Survey No.58 of Kannaraopet Village, Nallabelly Mandal for conducting the joint survey and pursuant to the said letter, the SDPO, Narsampet, has endorsed to the Circle Inspector of Police, Narsampet Rural for taking necessary action as per law, vide letter dated 07.05.2012.

Learned Government Pleader would further submit that pursuant to the said endorsement, the Circle Inspector of Police has directed the Sub Inspector of Police, Nallabelly, to provide police protection to the petitioners' property. Accordingly, on 08.05.2012, the Sub Inspector of Police, Nallabelly Police Station, along with the staff had provided protection to the officers of Revenue and Mines and Geology Department for conducting joint survey of the petitioners land and the survey has been conducted peacefully on 22.04.2012 as well as on 08.05.2012. These facts submitted by the learned Government Pleader are not controverted by the learned counsel for petitioners and he admitted that the cause in the writ petition no more survives in view of the aforesaid compliance.

Accordingly, this writ petition is closed. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
