HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO. 3131 of 2019 ORDER :

The petitioner, who is accused No.1, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.306 of 2019 of Women Police Station, D.D., Hyderabad, registered for the offences punishable under Section 498-A IPC and Sections 4 and 6 of Dowry Prohibition Act.

The case of the prosecution is that on 27.05.2019, the de facto complainant gave a complaint alleging that she got married A1/ petitioner in the year 2012. Out of the wedlock, they were blessed with baby girl on 10.10.2014. It is alleged that after a week of the marriage, when her husband left for Bhopal, the mother-in-law of the informant started harassing her and when the same was informed to her husband, he asked her to come to Bhopal. Accordingly, both of them lived happily for few days. Thereafter, her in-laws got shifted to Parbhani, Maharashtra and from then the mother-in-law of the informant started visiting her house. Since then, her in-laws provoked the husband of the informant and all of them started harassing her physically and mentally and also demanded her to get additional dowry.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

It has been submitted by the learned counsel for the petitioner that the entire version of the prosecution is false and baseless. All the allegations made are omnibus in nature and do not constitute the offences alleged. The petitioner is well established and works for a reputed company in Vishakapatnam. The petitioner is ready to abide all the conditions imposed by this Court.

Learned Additional Public Prosecutor opposed the anticipatory bail application.

Looking into the nature of allegations leveled against the petitioner and in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. However, if the petitioner surrenders before the Court concerned within fifteen days from today and moves an application for bail, the same shall be considered, in accordance with law, on the same day. 7.
