This writ petition is filed challenging the impugned proceedings vide Rc.No.E2/5210/2017, dated 23.02.2018, issued by the 2nd respondent terminating the contractual services of the petitioner, by making allegations against the petitioner and in violation of principles of natural justice. Learned Assistant Government Pleader for respondents 1 to 3 submits that the petitioner is a contractual employee, as such, no enquiry is required before terminating the services, as already petitioner was issued notice. Leaned counsel for the petitioner relied on the Judgment rendered by the Division Bench of this Court in WP.No.21094/2014, dated 02.06.2017, wherein this Court held that termination of even temporary or contracted employee from service with a specific charge of misuse of funds, forgery of documents, casts a stigma which will affect her future employment and termination without holding enquiry is illegal.
In the present case also impugned termination proceedings were issued against the petitioner by the 2nd respondent without conducting any enquiry. In view of the same only on the ground of violation of principles of natural
justice, the impugned proceedings dated 23.02.2018, are set aside. However, this will not preclude the competent authority from taking action, in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
