THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5216 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by petitioners/accused Nos.1 to 8 seeking to quash the C.C.No.290 of 2013 on the file of the Judicial Magistrate of First Class at Narayanpet, for the offence under Sections 498-A and 506 I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.

Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

In any event, considering the nature of allegations against the petitioner Nos.2 to 8 - accused Nos.2 to 8, presence of the petitioner Nos.2 to 8 - accused Nos.2 to 8 before the trial Court is dispensed with except on the dates of framing of charges, examination under Section 313 Cr.P.C. and pronouncement of the judgment. However, the petitioner Nos.2 to 8 - accused Nos.2 to 8 shall be properly represented through their counsel before the trial Court. Considering the nature of allegations against petitioner No.1 - accused No.1, this court is not inclined to grant any relief to the petitioner No.1 - accused No.1 in this

Criminal Petition and accordingly the Criminal Petition is dismissed as far as petitioner No.1 - accused No.1 is concerned.

Accordingly, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
