HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO. 3124 of 2019 ORDER :

The petitioners, who are accused Nos.1, 11 to 13, filed the present application under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.59 of 2019 of Chinthalapalem Police Station, Suryapet, registered for the offences punishable under Sections 147, 148, 448, 427, 354B, 307, 324 read with Section 149 IPC and Section 7 of CLA.

The case of the prosecution is that the informant alleged in his complaint that on 08.06.2019, between 06.30 hours and 07.00 hours, while he was sitting in front of his house, some of the villagers by name Annapureddy Govardhan Reddy, Gaddam Narsireddy, Gaddam Venkat Reddy, Payala Anjaneyulu and some others formed into an unlawful assembly, took iron rods and sticks, attacked him and tried to kill him by beating on his right left and hand. It is further alleged that the said persons trespassed into the house of his brother's daughter-in-law i.e., Marudi Saidamma, MPTC, Thammavaram, damaged the house and four bikes and at that time his relative Narudi Narendar Reddy Janakamm came to the rescue. It is also alleged that unable to digest the victory of said Saidamma, who got elected as MPTC, the said persons attacked them. 3.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor.

It has been submitted by the learned counsel for the petitioners that the petitioners were falsely implicated in the above crime, without any material and without any preliminary enquiry with regard to involvement of the petitioners in the alleged crime.

Learned Additional Public Prosecutor vehemently opposed the anticipatory bail application. He stated that petitioner Nos.2 and 4 have already been arrested and even sent to judicial custody and that petitioner Nos.1 and 3 are involved in several criminal cases. Hence, the petitioners are not entitled for anticipatory bail.

Looking into the nature of allegations leveled against the petitioners, gravity of the offences alleged, I am not inclined to grant anticipatory bail to the petitioners.
