HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 1444 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to and connected with I.D.No.21 of 2000 on the file of the 1st respondent-Labour Court and quash the order dated 01.02.2002 passed therein holding it as illegal and arbitrary. A consequential relief is also sought to reinstate the petitioner into service with back wages and other attendant benefits. Heard Ms. K. Udayasri, learned counsel for the petitioner, and learned Government Pleader for Labour appearing on behalf of the respondents.

It has been contended by the petitioner that he was appointed as Steward in the 2nd respondent hotel on 15.11.1996 and while he was discharging his duties during January, 2000 the 2nd respondent has terminated his services orally. Challenging the same, he filed I.D.No.21 of 2000 on the file of the 1st respondent-Labour Court under Section 2-A(2) of the Industrial Disputes Act and the Labour Court vide orders dated 01.02.12002 dismissed the said I.D. without appreciating any of the contentions raised by him. The same is questioned in the present writ petition.

Learned Government Pleader has contended that the Labour Court has rightly passed the orders impugned in the writ petition and the petitioner could not point out any irregularity or illegality in the orders of the Labour Court and in the absence of the same, this Court

should not normally interfere with the orders passed by the Labour Court.

This Court having considered the rival submissions made by the learned counsel on either side is of the considered view that the Labour Court has rightly dismissed the I.D. preferred by the petitioner and the petitioner could not point any irregularity or illegality in the orders passed by the Labour Court and in the absence of the same, this Court cannot interfere with the orders passed by the Labour Court. I find no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
