THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.20297 of 2017 ORDER:

The petitioner prays for Mandamus declaring the action of respondents 2 to 10 in not considering his representation/ objection filed on 12.05.2017 concerning Sy.Nos.132, 133 and 508 admeasuring Ac.23-07 gts., at B.Pochampally Village and Mandal, Yadadri District, Telangana State, as illegal and unconstitutional.

The petitioner apprehending alleged change of physical features or obtaining permission from respondents 2 to 10 by respondents 11 to 14, has filed the representation/ objection referred to above. Admittedly, a few cases are pending under Section 90 of the A.P.(Telangana Area) Tenancy and Agricultural Lands Act, 1950 between petitioner and respondents 11 to 14.

This Court is of the view that the petitioner can always move the authority before whom the lis is pending between parties for protection and preservation of property or physical features. Further, the petitioner is already before respondents 1 to 8 by way of caveat through representation dated 12.05.2017. The prayer is against the inaction and this Court is not inclined to consider the prayer at this stage, but liberty is given to petitioner to take appropriate steps in the pending litigation.

With the above observation, the writ petition is disposed of. No order as to costs.
