THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.11827 of 2019 ORDER:

The case of the petitioner is that the petitioner was issued notice on 31.05.2019 by the 1st respondent and the petitioner has filed an explanation on 06.05.2019. But, without considering the said explanation, the respondents are trying to take coercive steps against the petitioner. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.

Learned counsel for the petitioner submits that the 2nd respondent, on instructions from the 1st respondent, disconnected the electricity, which is illegal and arbitrary.

On the other hand, learned Standing Counsel appearing for the 1st respondent submits that without obtaining necessary permission, the petitioner made constructions. As such, the petitioner was issued impugned notice.

Since the petitioner has submitted explanation, dated 06.05.2019, in pursuance to the notice, dated 31.05.2019, the 1st respondent is directed to consider the explanation of the petitioner and pass appropriate orders, in accordance with law, within a period of one week from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
