HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4811 of 2015 ORDER:
This petition is filed by the petitioner-accused No.2 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in S.C.No.551 of 2014 on the file of VII Additional Metropolitan Sessions Judge, Hyderabad.
Heard and perused the material available on record. It is alleged in the complaint that while the complainant was returning to his house on TVS camp after attending the function and while he was passing from the new road, Shalibanda, some persons stopped him at Gautham School and attacked him and stabbed him with a knife and they pulled the petrol pipe of their motor cycle and set fire, due to which the motor cycle was burnt. After completion of investigation, charge sheet was filed against the petitioner and others for the offence punishable under Sections 147, 148, 302, 435 and 153A r/w 149 IPC. In connection with the above offence, the petitioner was arrested and later, he was released on bail vide order dated 20.7.2010 in Crl.M.P.No.2190 of 2010 in Crime No.52 of 2010.
Subsequently, NBWs were issued against him on the ground that he was absconding. Pursuant to the same, he was arrested on 17.6.2014. Then, he filed Crl.P.No.1586 of 2015 and the same was dismissed on the ground that he has absconded and if he is released, he may not appear and further, he is neither willing to engage counsel nor accepting the legal aid provided by the Court and thus, he is dragging on the case before the trial Court.
Considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
