THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37032 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the first respondent in issuing the proceedings in Rc.No.A5/1205/2016, dated 29.02.2016, keeping the petitioner under suspension as Single Trustee to Sri Veera Bhadra Swamy Temple, China Cumbum Village, Cumbum Mandal, Prakasam District and not concluding the enquiry by the first respondent as illegal and arbitrary. Heard and perused the material.

Learned counsel for the petitioner submits that petitioner is suspended for removing the Lord Ganesh idol in the above temple without taking previous permission. He further submits that due to vastu principles, the petitioner has removed the Ganesh idol, but he has installed the said Ganesh idol in the same temple. Learned counsel for the petitioner, after arguing for sometime, seeks a direction to the first and third respondents to conclude the enquiry within a stipulated time as the petitioner has been under suspension for the past nine months. Considering the facts and circumstances of the case, the first and third respondents are directed to conclude the enquiry against the petitioner as early as possible, preferably within a period of two months from the date of receipt of copy of this order.
