HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11811 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondent No.3 in not conducting the investigation in proper prospective in pursuant to the complaint made by the petitioner against respondent Nos.4 and 5 and in laying of charge sheet in CC.No.714/2018 on the file of the IV Additional Chief Metropolitan Magistrate under Section 406 IPC instead of Sections 379 & 411 of IPC.

Learned Assistant Government Pleader for Home submits that petitioner has alternative remedy of filing application under Section 216 of Cr.P.C. before concerned Court instead of approaching this Court.

Learned Counsel for the petitioner states that the writ petition can be disposed of recording the aforesaid submission of learned Assistant Government Pleader.

In view of the above, the writ petition is disposed of granting liberty to the petitioner to avail alternative remedy by filing application under Section 216 of Cr.P.C. before concerned Court. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
