THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9763 OF 2018 ORDER:

Heard learned counsel for the petitioner, Sri R.Vinod Reddy, learned Standing Counsel appearing for respondent Nos.1 to 3, and Sri Ch.Siddhartha Sarma, learned Standing Counsel appearing for respondent No.4.

When the matter is called, it is brought to the notice of this Court by the learned counsel for the petitioner that in identical circumstances, this Court disposed of W.P.No.26340 of 2017 by way of an order, dated 08.08.2017, and a copy of the same is placed on record along with the writ petition as a material paper. It is a fact that the said writ petition was disposed of by following the earlier order, dated 13.02.2017, of this Court in W.P.M.P.No.3057 of 2017 in W.P.No.2608 of 2017. The operative portion of the said order reads as under:

"In view of the above, this Writ Petition is also disposed of with a direction to the respondents to release the power supply to the premises of the petitioner subject to the compliance of the terms and conditions and on furnishing an undertaking to produce the occupancy certificate from the concerned Municipality/Municipal Corporation within the prescribed period, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs." 3.

Following the above said order and for the reasons stated therein, this writ petition is also disposed of, with a direction to the respondents to release the power supply to the premises of the

petitioner subject to the compliance of the terms and conditions and on furnishing an undertaking to produce the occupancy certificate from the concerned Municipal Corporation within a prescribed period, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. There shall be no order as to costs.

Office to enclose a copy of the order, dated 08.08.2017, in W.P.No.26340 of 2017 to this order.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
