JUDGMENT: (Per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) The appellant has challenged the legality of the order dated 10.06.2019 passed by a learned Single Judge in W.P.No.10728 of 2019, whereby while issuing notice to the respondent No.5, the learned Single Judge has not passed any interim order staying the proposed disconnection of electricity supply. Mr. Thakur Ratan Singh, the learned counsel for the appellant, submits that subsequent to the passing of the said impugned order, in fact, the electricity supply has been disconnected by the respondent No.2. Since the appellant is running a wine shop, despite the demand for chilled beer, the appellant cannot supply chilled beer to his customers. Therefore, the appellant is suffering great financial loss.

This Court has asked a pointed query to the learned counsel for the appellant whether the appellant has filed any application for modification of the impugned order dated 10.06.2019 or not? To this query, the learned counsel for the appellant submits that already an appellant has filed an I.A for modification of the said order. According to him, the said I.A is slated to be listed on 20.06.2019. However, he has a bona fide apprehension that the said I.A may not be decided on 20.06.2019 resultantly leading to further financial loss to be suffered by the appellant. Keeping in mind the bona fide apprehension of the appellant, this Court requests the learned Single Judge to decide the I.A filed by the appellant for modification of the order dated 10.06.2019 on 20.06.2019.

With these directions, the Writ Appeal stands disposed of. There shall be no order as to costs.

The miscellaneous petitions pending, if any, shall stand closed.
