This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.6740 of 2019 on the file of XVII Additional Chief Metropolitan Magistrate, Hyderabad. I.A.Nos.2 and 3 of 2019 in Crl.P.No.3136 of 2019 are filed seeking permission of this Court to compound the offence under Section 354 (B and D) of IPC and to record the compromise and quash the proceedings in C.C.No.6740 of 2019 on the file of XVII Additional Chief Metropolitan Magistrate, Hyderabad, respectively, inter alia stating therein that at the intervention of elders and well wishers, both the parties have amicably settled the matter out of the Court and both of them have married on 14.04.2019 and to that effect Social Marriage Dalitha Kalyana Vedika Sangam issued Marriage Certificate bearing No.
3833/3834 and both of them are living together as husband and wife and leading a happy marital life. Since the petitioner/Accused and respondent No.2/defacto complainant have compromised the disputes pending between them, respondent No.2/defacto complainant has no objection to quash the proceedings in C.C.No.6740 of 2019 on the file of XVII Additional Chief Metropolitan Magistrate, Hyderabad.
GSD, J Crl.P.No.3136 of 2019 Along with the applications, a Joint Memo duly signed by both the parties has been filed before this Court and their signatures were identified by the learned counsel for the respective parties. The compromise petition is supported by an affidavit filed by respondent No.2/defacto complainant. In view of the compromise arrived at between both the parties, I.A.Nos.2 and 3 of 2019 are allowed. Accordingly, this Criminal Petition is allowed in terms of the above compromise arrived at between both the parties and the proceedings in C.C.No.6740 of 2019 on the file of XVII Additional Chief Metropolitan Magistrate, Hyderabad, are hereby quashed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
