HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.1956 of 2018 ORDER : (Oral) Vide the present petition, petitioners seek suspension of operation of judgment and decree in O.S.No.198 of 201, dated 30th May 2015 on the file of the Senior Civil Judge, Mangalagiri and to stay further proceedings including execution proceedings. 2.

As stated by the counsel for petitioners, the respondents/ plaintiffs have filed suit for specific performance. Same was decreed vide judgment and decree dated 30th May 2015. Being aggrieved, the petitioners filed A.S.No.204 of 2015 with I.A.No.2715 of 2015 for suspension of decree dated 30th May 2015. In the said I.A., notice is issued and posted to 25.11.2015 initially. Thereafter, till date, no orders are passed by the appellate Court in it and it is being adjourned from time to time. In the meanwhile, the respondents/plaintiffs filed E.P.No.106 of 2015 on the file of Senior Civil Judge, Mangalagiri and the petitioners are apprehending that the said Court may pass order in the E.P. at any time, in which event, A.S.No.204 of 2015 filed by the petitioners, will get frustrated.

Keeping in view the facts and circumstances of the case, I hereby direct the learned appellate Court to take a decision on I.A.No.2715 of 2015 filed by the petitioners as early as possible. Till then, the executing Court shall not pass any orders in the E.P. mentioned above.
