There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- "...to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 3rd respondent herein in not taking any action on the complaint dt.25-4-2014 submitted by the petitioner for taking action against the 4th respondent for committing theft of Vehicle and for extending threats to do away with his life, in spite of the repeated visits, as being illegal, arbitrary and unjust, and consequently direct the respondent No.3 herein to register a criminal case pursuant to the complaint dt.25-4-2014 and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions issued by the Station House Officer, Chandanagar Police Station. From the perusal of the said written instructions, it is revealed that the Court referred the private complaint filed by Babu Rao, Tiruvedhula, Miyapur, i.e., the petitioner herein, on 20.05.2014. After verification of the contents of the petition, the place of offence does not come under the territorial jurisdiction of Chandanagar Police Station. The petitioner resides in Flat No.201, Pearl Block, My Home Jewels, Miyapur, which comes

within the territorial jurisdiction of Miyapur Police Station. Basing on the above said two points, the 3rd respondent returned the private complaint, which was filed by the petitioner, to the XIX Metropolitan Magistrate Court, vide No.2850 of 2014, dated 21.05.2014, with a prayer to forward the said private complaint to the Station House Officer, Miyapur, on the point of jurisdiction. It is also further mentioned in the instructions that the petitioner neither approached the police station nor sent any complaint.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition, since the complaint of the petitioner has been forwarded to the XIX Metropolitan Magistrate Court to forward the same to the Station House Officer, Miyapur Police Station, on the point of jurisdiction. As such, the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
