O R D E R

The prayer of the petitioner in this case is as under: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Honourable Court may be pleased to issue a Writ of Mandamus or any other appropriate writ declaring that the petitioner is entitled to the benefit of land pooling scheme for the extent of Ac.0.87.50 cents in Sy.No.63-C of Kondamrajupalem Village, Tulluru Mandal, Guntur District, in view of actual consumption of the said land and for a direction to the respondents to allow/grant all the benefits to the petitioner without being influenced by the extent of land mentioned in the pattadar pass books and title deeds and grant such other relief as it deems fit in the circumstances of the case.'

When the matter came up for admission on 07.01.2016, it was adjourned enabling the learned senior counsel appearing for the petitioner to ascertain as to whether his client would avail the remedy provided under Section 50(2) of the Andhra Pradesh Capital Region Development Authority Act, 2014 (for brevity, 'the Act of 2014'). It appears that no steps have been taken in this regard. Today, when the matter is moved by way of a lunch motion, learned counsel for the petitioner as well as Sri D. Ramesh, learned standing counsel for the Andhra Pradesh Capital Region Development Authority, would state that the issue in this writ petition as regards the disputed claims over the same piece of land would fall within the ambit of Section 50(2) of the Act of 2014.

In the light of the efficacious alternative remedy afforded to the petitioner under the statute, this Court is not inclined to entertain this writ petition. It shall be open to the petitioner to avail the remedy provided under the aforestated statutory provision and seek interim protection also. The writ petition is accordingly dismissed.

Pending miscellaneous petitions shall also stand dismissed in the light of this

final order. No order as to costs.
