2017-08-01M.Satyanarayana Murthy2 pages

HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRL.R.C.M.P.No.3534 of 2017 in/and CRIMINAL REVISION CASE No.2316 of 2010 COMMON ORDER :

Crl.R.C.M.P.No.3534 of 2017 is filed under Section 320(6) of Criminal Procedure Code (for short, 'Cr.P.C.') for recording compromise as the matter is settled out side the Court. 2.

Both the parties are present in person and they are identified by their respective counsel and they unanimously stated that they entered into compromise voluntarily.

3.

As per the terms of compromise, the revision petitioner i.e., husband executed a registered settlement deed in favour of respondent No.3 in Crl.R.C.-Atluri Durga Bhavani, who is daughter of the revision petitioner herein, and the revision petitioner handed over a demand draft for Rs.1,00,000/- drawn on Andhra Bank, Gangavaram Branch, in favour of his daughter-respondent No.3 in Crl.R.C.-Atluri Durga Bhavani. This Court read over and explained the terms and conditions in Telugu and they admitted the same as true and correct. Therefore, I find that the settlement is voluntary. 4.

Since the settlement is in the interest of both parties, I find that it is a fit case to record compromise entered into between the parties. 5.

Accordingly, the petition is allowed.

Crl.R.C.No.2316 of 2010:

6.

In view of the order passed in Crl.R.C.M.P.No.3534 of 2017, this revision is allowed in terms of memorandum of compromise. No costs.

7.

Miscellaneous petitions pending, if any, shall also stand closed. _________________________________ M. SATYANARAYANA MURTHY, J 1st August 2017 mar
