THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.11856 of 2019 ORDER:
The petitioner is challenging the suspension order dated 16.10.2018 passed by the 5th respondent.
When the matter is taken up for hearing, learned Government Pleader had produced the proceedings dated 13.05.2019 issued by the 5th respondent wherein it is stated that the petitioner was reinstated into service, without prejudice to the pending enquiry against him.
In view of the fact that petitioner was reinstated into service, the cause in the writ petition does not survive for adjudication and has become infructuous.
Therefore, the writ petition is dismissed as infructuous. However, learned counsel for the petitioner submits that petitioner had submitted a representation on 05.06.2019 to the respondents informing that he had met with an accident. If that be so, the respondents shall consider the representation of the petitioner and pass appropriate orders in accordance with law. No order as to costs.
